Supplying Machinery Against Government Tenders in Kenya, Nigeria, Ghana and Ethiopia

Supplying Machinery Against Government Tenders in Kenya, Nigeria, Ghana and Ethiopia

Public tenders move a large share of the industrial machinery that enters East and West Africa. Ministries, water authorities, municipal councils, agricultural development agencies and state-owned processing plants all buy through competitive tender rather than over the counter, and in Ethiopia a significant portion of national imports is solicited that way. For a distributor or local agent, winning that work depends less on quoting the lowest price than on arriving with a bid that survives the evaluation committee's compliance check.

EquipMachines supplies machinery against international tenders in all four markets. This guide sets out what each country's procurement system requires from a foreign manufacturer, and what we issue so that a local bidder can submit a complete, compliant file.

Tenders are lost on paperwork long before price is opened

Most competitive tenders for goods are evaluated in two stages. The first is a preliminary or responsiveness check against the mandatory requirements. Bids that fail it are set aside and the financial envelope is never opened, however keen the pricing. The documents that cause failure at this stage are almost always the same three: a missing or incorrectly worded manufacturer's authorisation, a technical submission that does not visibly answer the bill of quantities line by line, and a bid security in the wrong form or from an unapproved institution.

None of these are difficult to get right. They are simply the responsibility of the manufacturer rather than the local agent, and they have to be requested early enough to arrive before the submission deadline.

Kenya Tender and government supply from China

Kenyan public procurement runs under the Public Procurement and Asset Disposal Act, overseen by the Public Procurement Regulatory Authority. Tender notices are published on the Public Procurement Information Portal at tenders.go.ke, and procuring entities also advertise on their own sites. The PPRA maintains a debarment list, so confirming that neither the bidder nor its principal appears on it is a sensible first step.

Bid security is commonly specified as a percentage of the bid sum, issued by a bank in Kenya or by an insurance firm approved by the PPRA. A guarantee from an institution outside that approved list will be rejected at the preliminary stage.

The point that catches machinery suppliers is conformity assessment. Kenya operates the Pre-Export Verification of Conformity programme under the Kenya Bureau of Standards, and a Certificate of Conformity is a mandatory clearance document for each consignment. The programme's definition of mobile equipment expressly covers agricultural and industrial machinery, excavators, graders and bulldozers — so most of what moves under a plant or works tender is in scope. Certification happens before shipment, through a KEBS-appointed contractor, and a CoC cannot be amended once issued. Goods that arrive without one face destination inspection and the delays that come with it.

Nigeria Tender and government supply from China

Nigeria's conformity layer is SONCAP, the Standards Organisation of Nigeria Conformity Assessment Programme, in force since 2005. Regulated goods need two documents: a Product Certificate, which is required to process Form M, and a SONCAP Certificate, which Customs requires to clear the consignment. Both are obtained through a SON-appointed inspection body before shipment.

There is a provision worth knowing. Where a bona fide manufacturer is importing machinery or related spare parts for its own production, SON advises applying for a SONCAP import permit rather than routing the consignment through standard product certification. On a tender where the end user is a factory or processing plant rather than a trading entity, that route can save several weeks. It has to be raised at bid stage, not after award.

Ghana Tender and government supply from China

Ghana procures under the Public Procurement Act, 2003 (Act 663), as amended by the Public Procurement (Amendment) Act, 2016 (Act 914), regulated by the Public Procurement Authority. Tender notices appear in the Public Procurement Bulletin and on the PPA website, and bidding has moved onto the Ghana Electronic Procurement System, GHANEPS, which the PPA has made mandatory for covered entities. Supplier registration on the platform is required before a bid can be submitted, so a local agent should complete it well ahead of any specific tender.

Ghana applies margins of preference for local suppliers on certain contracts. This rarely excludes a foreign manufacturer from larger machinery contracts, where there is no comparable domestic production, but it does mean a bid should be structured through a registered local agent wherever the tender permits it.

Ethiopia

Federal procurement in Ethiopia follows the Procurement and Property Administration Proclamation No. 649/2009, with a large volume of goods tendered through the Public Procurement and Property Disposal Service. Open national tendering is generally stated as being open to bidders from eligible source countries, with eligibility defined in the tender document itself rather than by a standing registration list.

The logistical constraint shapes everything else. Ethiopia is landlocked, and consignments route through Djibouti and then inland by road or rail. Transit time and inland haulage have to be built into the delivery schedule quoted in the bid, because a delivery period that looks competitive on a port-to-port basis will be missed once the corridor is accounted for. Packing specification matters more here than in the coastal markets: machinery is handled more times and travels further by road.

What we issue for a tender bid

  • Manufacturer's authorisation. Issued in the name of the bidding entity for the specific tender number, in the wording the tender document requires.
  • Compliance statement against the bill of quantities. Written line by line against the technical specification, stating comply or deviation with a reference, rather than a general brochure.
  • Datasheets per item. One per line item, matched to the model actually quoted.
  • Price held for the tender validity period. Quoted FOB, CIF or DDP as the tender specifies, and held for the stated validity.
  • Conformity documentation. Pre-export inspection arranged under the destination country's scheme, and a pre-dispatch inspection report before loading.
  • Destination-matched build. Voltage, phase and frequency set for the market before the machine is built, with installation drawings, operating manuals and a spare parts list shipped with the consignment.

Ranges are frequently combined on a single bill of lading where one tender covers several categories — hand tools and machines, safety and security equipment and army and military products are often required together on a ministry or agency contract.

Frequently asked questions

Will you issue a manufacturer's authorisation before the bid is submitted?

Yes. Send the tender number, the closing date, the bidding entity's registered name and the required wording, and the authorisation is issued ahead of the deadline.

Can you quote DDP rather than FOB?

Yes, where the tender specifies it. Delivered terms are quoted with freight, insurance and inland haulage included, which matters particularly for Ethiopia via Djibouti.

Do you supply pre-export conformity certification?

Inspection is arranged under the destination scheme — PVoC for Kenya, SONCAP for Nigeria, and the equivalent requirement where one applies. Certification is completed before shipment, as the programmes require.

Can one tender cover machinery from several of your categories?

Yes. Items are quoted line by line and consolidated into one consignment on a single bill of lading.
